OpenInk Hub provides smart digital marketing workflows and automation platforms, including but not limited to:

• SEO & Workflow Automation: Smart workflows for website tracking, optimization, and content management.
• GMB Automation: Local SEO automation solutions for managing Google Business Profile listings, reviews, and updates.
• WhatsApp Business API Platform: Automated messaging frameworks, chatbots, and customer engagement tools.
• AI Blog Automation & Social Media Automation: AI-driven content creation, scheduling, and distribution tools (including upcoming modules).

2. Account Registration and Security

To access certain automation dashboards, you may be required to register for an account.

• You agree to provide accurate, current, and complete information during registration.
• You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must immediately notify us of any unauthorized use or security breach of your account.

3. Third-Party Integrations & API Usage

Our automation platforms rely on integrations with third-party networks (e.g., Google LLC, Meta Platforms, Inc., various Content Management Systems).

• Compliance: Your use of our GMB or WhatsApp tools must strictly comply with the respective third-party terms (e.g., Google API Services User Data Policy, Meta WhatsApp Business Terms).
• API Interruptions: We are not responsible for any disruptions, account suspensions, or changes in functionality caused by updates, policy changes, or limitations imposed by these third-party platforms.

4. Client Responsibilities & Acceptable Use

You represent and warrant that your use of our automated tools will not violate any applicable local, state, or international laws.

• WhatsApp Communication: When using our WhatsApp Business API Platform, you are strictly designated as the Data Controller. You must obtain explicit, legally compliant opt-in consent from end-users before initiating automated messages. Spamming, bulk-messaging unconsented numbers, or broadcasting prohibited content will result in immediate termination.
• Content Rights: You retain ownership over data and content provided to our systems. You grant OpenInk Hub a limited license to process, format, and transmit this data strictly to execute your automated campaigns.

5. Fees, Billing, and Subscriptions

• Pricing: Services are billed on a subscription or project basis, as outlined during your onboarding or package selection.
• Payment: All payments must be made via our approved payment channels. Late payments may result in the automated suspension of your API access and dashboards.
• Refunds: Cancellation and refund eligibility are subject to our standard Refund & Cancellation Policy.

6. Intellectual Property Rights

Unless otherwise indicated, the Site, its source code, databases, functionality, software, AI workflow configurations, website designs, and graphics are our proprietary property and are protected by copyright and trademark laws. You are granted a limited, non-exclusive license to use the platform for your internal business operations during the term of your active subscription.

7. Limitation of Liability & Disclaimers

• “As-Is” Basis: Our services and automation tools are provided on an “as-is” and “as-available” basis. We do not guarantee that search engine rankings (SEO/GMB) will increase by a specific metric, as algorithms remain under the sole control of third parties like Google.
• Liability Cap: To the maximum extent permitted by law, OpenInk Hub shall not be liable for any indirect, incidental, or consequential damages—including loss of profits, data, or business opportunities—arising from your use or inability to use our automation systems.

8. Termination

We reserve the right, without notice or liability, to terminate or suspend your access to our services if you breach any part of these Terms, fail to clear outstanding balances, or engage in activities that threaten the stability of our infrastructure.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Ranchi, Jharkhand, India.
